Resident convicted for 18 days

A LIVINGSTONE resident from Malota Township Kenneth Kalomo, unknown
age, has been sentenced to 18 days in prison for removing Patriot
Front (PF) campaign posters in the city.
This was after Mr Kalomo pleaded guilty to a charge of removing PF
campaign posters in the city contrary to the laws of Zambia.
Mr Kalomo appeared before Livingstone magistrate Chola Musonda yesterday.
Facts before the court are that on the 5th of February Evans Mubanga
was sticking posters in the compound and then saw the accused who was
removing the posters.
Mubanga then informed the police, who later arrested the accused.
In mitigation, Kalombo said that he had two children, and he was an
orphan and he was the sole bread winner for his siblings.
Kalombo begged for forgiveness from the court and that he would never
do it again as he had learnt his lesson.
And in sentencing him, magistrate Musonda said that offence in
question attracts a maximum sentence of two years but sentenced him to
18 months since the convict had shown remorse.
Magistrate Musonda sentenced him for 18 days from the date of the
arrest on February 5, 2013.
And in another court, magistrate Andrew Kasongo has warned prosecutors
to ensure that they follow up cases with the director of public
prosecution (DPP) that bring before his court.
This was after the case of Judith Kayuma, who has been charge of
murder contrary to section 200 of the Penal Code chapter 87 of the
laws of Zambia failed to take off and has been appearing for mention
since October last year.
Magistrate Kasongo said that from the 28th of October up to date the
DPP had not made up him mind.
“We don’t try murder cases here, it appears the DPP is slow in making
up his mind, you will continue appearing before this court,” he
said.
Magistrate wondered whether it was true that the DPP had not made his mind.
He advised the prosecutors that they was a way of going the DPP by go
up to preliminary inquire.
He told the prosecutors that if the accused makes an application.
