ZLDC urged- GOVT

Secretary Dr. Chileshe Mulenga has urged the Zambia Law Development Commission
(ZLDC) to continue acting as a catalyst of change in government’s endeavor to
be responsive to the needs of the Public and Compliance to Human rights
obligation.
Speaking when he officiated at
a two days consultative workshop on the review of the penal code and criminal
procedure code organized the by Zambia Law Development Commission in
Livingstone on Wednesday, Dr. Mulenga said the task was not easy as the two
statutes were inherited from the colonial masters and have been amended
repeatedly.
“Specialized legislation
such as the plea negotiations and agreements act have been enacted thereby
posing the danger of contradiction in the penal law of the country,” Dr. Mulenga
said.
He said that the fact that no
comprehensive review has ever been undertaken poses the threat of the penal
laws that lag behind social development and modern human rights standards.

should reflect the country’s contemporary environment and commitment to human
rights
And ZLDC Deputy Director
Joyce Shezongo MacMillan disclosed that the review of the penal code and
criminal procedure code commenced in March 2011to identifying key areas of
concern in the two statutes.
Ms. MacMillan said that due
to the voluminous nature of the two instruments, the commission developed a two
phased program with the first one focusing on the review of the penal code and
second phase on the criminal procedure code.
She said that the penal code
was further divided into sub-projects with the first focusing on sentencing.
Ms. MacMillan said that the
workshop taking place in Livingstone was convened to consult key stakeholders
on the second sub-project that focuses on punishment, publications, offences
against public tranquility, sexual offences and offences related to marriage.
She said that the commission
has so far held consultative workshops in Lusaka, Copperbelt and now in
Livingstone.
Ms. MacMillan mentioned that
the Zambia Law Development Commission (ZLDC) is an institution established by
an act of parliament whose functions are to undertake research and make
recommendations on the socio-political values of the Zambian people that should
be incorporated into legislation.
