A 37 year old Livingstone businessman has told the Livingstone high court that he is aware that it is an offence to cause an accident deliberately.

A 37 year old Livingstone businessman has told the Livingstone high court that he is aware that it is an offence to cause an accident deliberately.
This is in a case in which Enock Munsaka is charged with aggravated robbery.
It is alleged that May 8, last year in Livingstone, he jointly and whilst acting together with others unknown robed Owen Katungu Muteba of 27 cases of Astel lite beer and 8x 5 litre boxes cellar Cask wine altogether valued at K4,160.
Muteba was testifying before, Livingstone high court judge in charge Ernest Mukulwamutiyo, he said that his intention was to make the car stop.
Muteba said he got into his car and pursued the taxi with registration number AJD 473 which he later had a head on collision with.
“I know that causing an accident deliberately is an offence but I did not cause this accident deliberately as I had an intention of catching the thieves that had broken into my ware house,” he said.
Muteba said he was not under the influence of alcohol when he tried to apprehend the people that broke into his ware house.
“I drink occasionally I was not under the influence of alcohol when I had the intention of ramming into the oncoming vehicle with my car,” he said.
Muteba said when he ware house was broken into he was not there but he only saw someone jumping out the roof of his warehouse and that is how he pursued him.
“I hit the person that was coming out of my ware house with a stone as he tried to run away,” he said.
He said he never took the accused to Airport police station and when he reached there he was not happy with the way the officer has handed the matter.
