THE Livingstone Magistrate’s court has issued a bench warrant against the Department of National Parks and Wildlife Acting Director Chuma Simukonda for contempt of court by ordering police to disobey court orders.

THE Livingstone Magistrate’s court has issued a bench warrant against the Department of National Parks and Wildlife Acting Director Chuma Simukonda for contempt of court by ordering police to disobey court orders.
Magistrate Benjamin Mwelwa ordered that bench warrant against Simukonda be returned on February 2 this year.
“I have therefore issued a bench warrant against the Department of National Parks and Wildlife Acting Director Chuma Simukonda for contempt of court which is returnable on 2, February, 2016,” he said.
This is in a case in which Reuben Chikumba 34, a human resource officer at former ZAWA, assaulted his workmate, Nosiku Linenga 37, a public prosecutor.
Facts before the magistrate Mwelwa are that on September 4, last year, Chikumba of Nottie-broad area assaulted Linenga by squeezing and
pulling his private parts during a dispute and thereafter, allegedly facilitated his dismissal.
Magistrate Mwelwa said he was satisfied that the summons were service to the proxy of the acting director research James Milanzi, who told the officer in charge of Livingstone central police that the director was in a meeting.
“I am satisfied that the summons were service, there is evidence to that effect that he was served with the summons, and the reasons advanced by the state for him not coming to court are different from the proxy who was sent by the director, one Annie  Nkhoma,” he said.
And earlier State prosecutor inspector Chibwe Mwenya told the court that he was in receipt of return of summons by the officer.
“A return of the service was done, there is even a certificate of service singed by James Milanzi who received on behalf of Simukonda,” he said.
 He said Simukonda could not receive the summons as he was having a meeting with the ministry of tourism at Cabinet office.
He said summons was served on him at 12:25 hours on January, 25 this year.
